TERMS AND CONDITIONS: ORDERS
Order Policies & Terms
These Terms & Conditions apply to all quotes, invoices, orders, samples, customizations, and sales made by Bohophy. By placing an order, approving an invoice, or approving any mockup, sample, artwork, or production detail, the buyer agrees to these Terms & Conditions in full.
1. Production Start
Production lead time begins only after final payment is received and all artwork, quantities, customization details, and mockups are approved in writing. Production and shipping times typically range from 4 to 9 weeks after order placement, depending on quantities, material availability, seasonality, and final approval of all order details. Lead times are estimates only and are not guaranteed.
2. Lead Times
Estimated shipping and production times are provided in good faith but are not guaranteed. Delays caused by customs, carrier issues, force majeure, peak seasons, material shortages, or approval delays are outside Bohophy’s control.
3. Approval of Mockups and Samples
Once mockups, samples, artwork, spelling, logos, colors, and placement are approved by the buyer, Bohophy is not responsible for errors later discovered in approved materials.
4. Natural Variations
Due to the handmade nature of our products and the use of natural materials, variations in color, weave, straw, texture, grain, shape, finish, size, engraving depth, and overall appearance are normal and are not considered defects.
Measurements may vary within a reasonable handmade production tolerance.
5. Samples and Final Production
Approved samples and mockups are for reference only. Minor differences between samples, mockups, and final production may occur.
6. Shipping Terms / Risk of Loss
Risk of loss and title transfer to the buyer once the goods are delivered to the carrier at the FOB shipping point in Mérida, Yucatán, Mexico.
7. Inspection and Claims
Any claim for shortages, visible damage, or incorrect items must be submitted in writing within 24 hours of delivery, with photos and supporting documentation.
Measurements and natural variations within reasonable handmade production tolerance are not considered defects.
8. Cancellations / Changes / Refunds
Custom and made-to-order items cannot be canceled, changed, or refunded once production has begun.
9. Storage / Delayed Shipment
If shipment is delayed at the buyer’s request after production is complete, Bohophy may charge reasonable storage and handling fees.
10. Customs and Import Responsibility
The buyer is solely responsible for import clearance, duties, VAT, tariffs, brokerage fees, compliance at destination, and any additional destination charges.
11. Outdoor / Use Disclaimer
Unless expressly stated in writing, Bohophy does not guarantee performance under specific environmental conditions, including prolonged outdoor use, humidity, oceanfront exposure, direct sunlight, or heavy commercial wear.
12. Limited Claim Remedy
Bohophy’s sole obligation for any approved claim shall be, at its discretion, repair, replacement, or refund of the affected portion only. Bohophy shall not be liable for indirect, incidental, or consequential damages.
13. Color Reproduction
Digital mockups, screens, and printed proofs may display colors differently from final production.
14. Packaging / Shipping Damage
Bohophy is not responsible for damage occurring in transit once the order has been released to the carrier, though we will reasonably assist with carrier claims when possible.
15. Payment Default
Late payments may delay production and shipment. Bohophy reserves the right to suspend work until payment is received.
16. Intellectual Property
The buyer represents and warrants that it has the full right, authority, and permission to use any logos, trademarks, names, artwork, text, designs, or other materials provided to Bohophy for customization or production.
The buyer agrees to indemnify and hold Bohophy harmless from any claims, damages, costs, or liabilities arising from the use of materials supplied by the buyer.
17. No Warranty Unless Expressly Stated
Except as expressly stated in writing, Bohophy makes no warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or suitability for a specific environment or use.
18. Limitation of Liability
For any approved claim, Bohophy’s sole and exclusive obligation shall be limited, at Bohophy’s discretion, to the repair, replacement, or refund of the affected goods only.
Bohophy shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, loss of use, reputational damage, delay-related costs, event disruption, or third-party claims.
19. Acceptance
By accepting a quote or invoice, approving mockups or samples, placing an order, or accepting delivery of goods, the buyer confirms that it has read, understood, and agreed to these Terms & Conditions.
20. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Miami Beach, FL, USA, unless otherwise stated in writing.
21. Updates to Terms
Bohophy reserves the right to update or modify these Terms & Conditions at any time. The version in effect at the time of order approval shall apply to that order.
